Did you know that you can make an arrest?





If you didn't know, now you know. It is called arrest by a PRIVATE PERSON under Nigeria criminal procedures.

Arrest simply means to take or keep in custody by authority of Law. It also means to deprive a person of his liberty by legal authority.

 A private person can make an arrest where
1. A person commits an offence in his presence

2. A person is reasonably suspected of having committed a felony ( a felony is an offence of a more graver or serious nature. It is generally punishable by death or imprisonment with 3 years or more)

3. A person commits a misdemeanor by night (a misdemeanor is an offence punishable by imprisonment from 6 months to 3 years)

4. A person is found committing an offence which is injurious to his property

5. A person is found damaging a public property.

 6. Where he is ordered by a Judicial officer to arrest someone


In conclusion, it is noteworthy that where a private person makes an arrest, he shall not subject the arrested person to torture, inhuman or degrading treatment. He shall without unnecessary delay hand over such person to a Police Officer. In the absence of a Police Officer, he shall take him to the nearest Police Station.

Every year we welcome into our community several teenagers between 13 and 17 from far and near. They are both male and female. They have the same mission. They have come to write General Certificate Examination (G.C.E). Most of them are penultimate students in secondary schools. These little fellows have been fixed at centres nearby to write their exams and the people that brought them have accommodation as part of the payment agreement. Some of these children are leaving home for the first time. Some of them look like mom's pets. Immediately they hit the town, you see a lot of ambiance and noise, something like a carnival. They make noise in the morning while looking for water for domestic use and in the evening when they are back from their different centres.
